Understanding Accident-related Tort and No-fault Insurance Claims By Neinstein & Associates

Introduction • Led by Gary Neinstein, Toronto-based Neinstein & Associates offers dedicated personal injury law services that enable clients to achieve the maximum settlement possible. One issue many Ontario drivers inquire about after a motor vehicle accident is what role required no-fault (also known as Accident Benefits) insurance plays in their recovery of damages. A Neinstein & Associates blog article on this subject explains that, while the terminology is confusing, all accidents allow for entitlement to Accident benefits regardless of fault.

About No Fault Insurance • With no-fault insurance limited to coverage solely for lost income and medical expenses, tort claims are also important in cases of permanent and serious injury or death. Distinct from the no-fault insurance claim or Accident Benefits claims, tort claims must be forwarded as a formal written statement within 120 days of the accident.

Conclusion • In addition to this distinction, no-fault insurance and tort claims are complementary as they cover different aspects of the victim’s case. While nofault insurance has been designed with the intention of enabling the victim’s recovery, tort claims ensure that pain and suffering caused by the injury are also compensated.
