B.A.LL.B/B.B.A.LL.B 4th Semester 2009 Company Law-I 2nd Class Test Dr. Tabrez Ahmad, subject teacher Max. Marks: 5 Time 1 Hour (9 a.m to 10 a.m), 14/02/2009 Problem 1. Mr. Ramesh is pursuing his three year LL.B course from ABC College Cuittack. When he was to write his second year LL.B examination- he was denied a chance of writing the exam. The reason quoted for this action of college authorities is that of „attendance shortage‟. According to the XYZ University, to which LEK Law College is affiliated, a candidate has to attend at least 75% of the classes before taking term examination. Because of this attendance action he loses one precious year. When the suit is maintained it is brought to the notice of the court that, the „attendance sheets‟ of ABC Law College are not maintained regularly and in accordance to the normal practice. Now Mr. Ramesh claims Rs. 5, 00,000 as compensation from XYZ Law College. Advise Ramesh after explaining the law on this point. (5 marks). 2. The Technotravel a firm of carriers was given a wooden case for being carried from Bhubaneswar to Mumbai. The content of the box were not known. Finding some leakage in the box, Mr. Bublu an assistant driver in the firm took the box to the Technotravel office building to examine it. While the box was being opened by Mr. Bublu the Nitroglycerine in the box exploded and the office building, of the firm, was damaged. Now techno travel wants to file a suit against Mr. Bublu. Advice Technotravel. 3. Chaganbhai-Maganbhai & Co is a business enterprise, hired a crane and driver from the Nandi Construction Corporation. The driver, Mr. Maxwell, drove the crane inattentively and trapped Mr. Mcfarlane injuring him. The contract between the Nandi Construction Corporation and the hirers avowed that the driver was to become their employee for the period of the hire. Mr. Mcfarlane wants to file a suit in the court of law to get the damages. The question was whether the constriction corporation was liable to Mr. McFarlane as Mr. Maxwell‟s principal employer or whether the hirers now bore

responsibility. Please advice Mr. Mcfarlane about the “appropriate defendant” and his chance to get success by using the favorable principles and precedents on the point. Also mention your decision if you are judge in this case. (5 Marks)
