(OMSJ). Mr. Baker is the defendant in Murtagh v. Baker, a lawsuit filed in the Superior Court of California. The plaintiff, Dr. James Murtagh, is alleging among other claims, that Mr. Baker tortiously interfered with his contractual relationships. Dr. Murtagh is also alleging that several whistleblowers were instrumental in aiding Mr. Baker by violating their duties of confidentiality to him. One of those witnesses is David Pardo, whom I understand has a whistleblower reprisal complaint under investigation by your office. I wish to assure you that Dr. Murtagh’s allegations are false, and that we will be mounting a vigorous defense. Mr. Pardo helped my client publicly expose and hold Dr. Murtagh accountable for his misconduct. Because of this, he incurred Dr. Murtagh’s wrath. At no point, however, has Mr. Pardo divulged any information that he received from Dr. Murtagh which was not a matter of public record, nor do we believe that a duty of confidentiality ever existed between them. As part of proving the latter claim, we issued a subpoena to the Government Accountability Project. We understand that this may have caused some consternation within the whistleblower community. We seek to assure you that Mr. Pardo’s role is limited to bringing the truth to light in the aforementioned matter, by sharing his eyewitness account.
