CRIMINAL COURTS: CRIMINAL COURTS Seeking Justice WHAT YOU WILL SEE: WHAT YOU WILL SEE The Prosecutors: The Prosecutors City Attorney: city laws; represents city officials District Attorney: felony cases submitted by police and sheriffs officials; represents county officials The Defense: The Defense Public Defender’s Office Private Attorney, hired and paid for by the defendant The Differences: The Differences CIVIL: Verdict does not have to be unanimous; just majority CRIMINAL: Verdict must be unanimous, otherwise mistrial The Case: The Case Charges are filed on behalf of “The People” Defendant = the person accused of the crime Key Proceedings: Key Proceedings Arraignment: hear/answer charges Preliminary Hearing: Test the evidence Plea Bargain/Trial Verdict The Verdict: The Verdict Defendants are found “not guilty” instead of innocent REMEMBER: The charges are just allegations (allegedly) until, or if, the defendant is found guilty The Punishment: The Punishment Incarceration in a jail or prison Fine paid to the government Execution of the defendant: the death penalty The Punishment: The Punishment Felonies: a maximum possible sentence of more than one year incarceration Misdemeanors: a maximum possible sentence of less than one year incarceration
